Limited Warranty
1. In brief
Your Purple Sound headphones are warranted against defects in materials and workmanship for a period of two (2) years from the date of original retail purchase from an authorised Purple Sound reseller in the European Union or for one (1) year from the date of purchase from an authorised Purple Sound reseller in any other country outside of the European Union. If your product is found to be defective during the period of this warranty, Purple Sound at its option will (1) repair the product at no charge using new or refurbished parts, (2) exchange the product with a functional equivalent product which is new or refurbished, or (3) refund the original purchase price.2. Limitations2.1 We do not cover normal wear and tear, blown speakers, damaged cords, bent jacks, scratches, loss or theft. The warranty specifically excludes damages resulting from abuse, accident, modifications or other causes which are not defects in materials and workmanship.
2.2 Any liability arising from a warranty claim is limited to the original purchase price.

2.3 No other person is authorised to modify this limited warranty. Your Purple Sound distributor or reseller is responsible for any other warranties.

2.4 This warranty only applies to countries served by a Purple Sound subsidiary company or an authorised distributor with responsibility for the country in which a warranty claim is being made.

2.5 Product registration and/or proof of purchase is required to verify eligibility to warranty.

3. Limited Warranty terms and conditions

3.1 Wherever Purple Sound has an authorised distributor, warranty terms will be exercised by the local Purple Sound distributor. Please contact your local distributor for the warranty details. Should the warranty period from the distributor/reseller exceed the Purple Sound warranty period it will remain the responsibility of the distributor/reseller.
Should the standard warranty terms of the distributor/reseller expire before those of Purple Sound, the Purple Sound terms will apply and the balance of the warranty period will be the responsibility of Purple Sound.

3.2 This Limited Warranty is transferable provided that the current owner furnishes the original proof of purchase from an authorised Purple Sound distributor/reseller.

3.3 Warranty period European Union:

- All Purple Sound products purchased from Purple Sound online or through authorised resellers in the European Union are guaranteed for TWO (2) years from the date of purchase to be free of defects in materials and workmanship. In the event of such defect, the product will be repaired or replaced without charge. This is provided that the product is correctly registered on the Purple Sound website and a valid purchase receipt is submitted with the product.
- Such products should be returned to the Purple Sound authorised distributor responsible for your country. Contact details for Purple Sound distributors in the European Union can be found on our website in the Where To Buy page.

3.4 Warranty period for countries outside of the European Union:
- All Purple Sound products purchased from Purple Sound online or through authorised resellers in countries outside of the European Union are guaranteed for ONE (1) year from the date of purchase to be free of defects in materials and workmanship. In the event of such defect, the product will be repaired or replaced without charge. This is provided that the product is correctly registered on the Purple Sound website and a valid purchase receipt is submitted with the product.
- Such products should be returned to the Purple Sound authorised distributor responsible for your country. Contact details for Purple Sound distributors outside of the European Union can be found on our website in the Where To Buy page.

3.5 Worldwide Warranty Information:
- Product purchased outside of the countries managed by Purple Sound or authorised distributors and resellers such as North America, Africa and South America are not covered by Purple Sound warranty. In the first instance, customers should contact the distributor or reseller within the country the product was purchased.
- In the event that it is not possible to return the product to the country or reseller where it was purchased and the customer wishes to return the product to a Purple Sound subsidiary, any repair or replacement undertaken by Purple Sound will not be covered under the terms of this warranty and any repairs would be chargeable.

4. Other rights and remedies
The provisions of this Limited Warranty apply in lieu of any other warranties or conditions, except those provided by law. This Limited Warranty provides you with specific rights subjects to specified conditions. You may have other legal rights and remedies which apply to the product you have acquired. These rights vary from country to country and state to state. Some countries or places do not permit the exclusion, restriction or modification of certain implied rights or their effect. In those instances this Limited Warranty will only apply to the extent that the applicable law allows and does not affect those rights.

1. Applicability
1.1 The following definitions apply in these Terms and Conditions:

- Forever Spring Limited: is the lead distributor of Purple Sound devices in the European Union and has its registered address at15 Town Meadow Drive, Shefford, Bedfordshire,

- Customer: any natural or legal person party to or involved in any legal act or act referred to in Article 1.2, or toward whom any legal act or act referred to in that article is directed, or from whom a request as referred to in that article originates;
- Products: all Purple Sound items that Go10 offers for sale to its customers through the Purple Sound Website;

1.2 These Terms and Conditions apply to all offers, order confirmations, deliveries of Products from Forever Spring to the Customer, to every order from the Customer to Forever Spring, and to all agreements between Forever Spring and the Customer as well as to every request by the Customer for the delivery of Products and, regardless of whether an agreement is or has been established, between Forever Spring and the Customer.

1.3 The Terms and Conditions also apply to any and all use by the Customer of Purple Sound’s Website.

1.4 If requested by the Customer, Forever Spring will provide these Terms and Conditions to the Customer, in electronic format. Customers are able, if they so wish, to save and print these Terms and Conditions and the agreement on a fixed or portable data carrier, using the facilities available on the Website, and for keeping the saved copy permanently available.

1.5 General terms and conditions observed by the Customer or other terms and conditions are not applicable. The Customer may only rely on alternative and/or additional terms and conditions if and to the extent that Go10 accepts them in writing. Such alternative or additional terms and conditions do not affect the applicability of the other provisions of these Terms and Conditions, and will apply exclusively to the agreement for which they are specifically and explicitly agreed to in writing.

1.7 Forever Spring reserves the right to change and/or make additions to these Terms and Conditions.

2. Communication

2.1 Any communication between Forever Springand the Customer may be made electronically, unless explicitly provided otherwise by the Terms and Conditions and/or the agreement and/or the law.

2.2 Forever Spring’s saved version of the communication in question will constitute evidence of this, except where the Customer has counterevidence.

2.3 Electronic communications will be deemed to be received on the date of transmission, unless the recipient has proof to the contrary. If the communication is not received because of delivery and/or accessibility problems regarding the Customer’s email inbox, this risk will be borne by the Customer, even if the email box is located with a third party.

3. Formation of and withdrawal from agreements

3.1 Any statement by Forever Spring on the Website regarding the availability of Products constitutes an invitation to make an offer. Every agreement is entered into under the condition that the Products in question are sufficiently available. An agreement is concluded by Go10′s confirmation of the Customer’s order. Confirmation may be made electronically (e.g. through the Website, by email or text message, or by similar technologies).

3.2 Forever Spring reserves the right to refuse orders by Customers at any time. In the event that Forever Spring refuses an order, it will notify the Customer of this as soon as possible following receipt of the order.

3.3 Information, images, communications, advertisements, quotations etc. placed on the Website or sent by email or any other means of communication about all offers and the major characteristics of the Products will be provided as accurately as possible. However, Go10 does not guarantee that all offers and Products correspond fully with the information provided. In principle, minor differences may not constitute cause for compensation and/or termination (including partial termination) of the agreement.

3.4 Under the Distance Selling Regulations 2000 the Customer has the legal right to cancel an order within seven (7) working days of receipt of the Products. To exercise this right to make a cancellation of an order after the Products have been despatched the procedure set out below must be followed and the additional terms will be effected:

Forever Spring will provide a refund or exchange provided the Products returned are in fully resaleable condition.
Should the Products be returned in damaged condition and unsuitable for resale, Forever Springreserve the right to refuse a refund on the Products, or to deduct up to 50% of the original selling price from the refund amount.
Forever Spring will refund the price of the item or exchange the Products if they were delivered in error or in a damaged or faulty condition once it is received by Go10. A refund of the delivery charge will be given in the instance of incorrect, damaged or faulty goods.
Forever Spring will make any refund due to the Customer within thirty (30) days from receipt of the returned Products.

4. Price

4.1 The price that is applicable to the Product at the time of order is shown in GB £ Sterling for all orders placed in the UK, in Euro for orders placed in all other European Union countries and un US $ Dollar for all other countries and inclusive of VAT or Purchase Tax, and exclusive of any statutory disposal contribution and transport or delivery costs. The percentage and amount of VAT or Purchase Tax as well as any statutory disposal contribution and transport or delivery costs will be specified on confirmation of order to the Customer by Go10.

4.2 Go10 may at all times correct mistakes in the price or description of a Product on the Website. Any Customer who has entered into an agreement based on such mistakes may cancel this agreement within 7 (seven) days after Go10 has informed the Customer of the mistake(s) in question.

5. Payment

5.1 Unless explicitly provided otherwise in writing, payment must be made by PayPal, without prejudice to the provisions of Article 5.4.
5.2 When the Customer make payment by means of the PayPal payment method, the terms and conditions of PayPal will apply. Go10 is not a party to the relationship between the Customer and PayPal.

5.4 Customers who meet their payment obligations in part, or fail to meet them or do not meet them in a timely manner, will be deemed to be in default by operation of law and any amount still owed to Go10 will be immediately due and payable without further demand or notice of default, increased by the statutory (commercial) interest rate calculated from the day following the expiration of the agreed period for making payment, with part of a month counting as a full month.

5.5 All judicial and extrajudicial costs incurred by Go10 for collecting amounts owed by a Customer will be borne by the Customer. Extrajudicial costs will be at least 10% (ten per cent) of the amount owed (including the interest referred to in Article 5.4) but no less than GB £150, and Euro 177 , US$230 without prejudice to Go10′s right to claim actual costs incurred if these are greater.

5.6 Any payment made by a Customer will first be applied toward any costs owed, or any interest owed, and, following full payment of these amounts, toward the Customer’s earliest outstanding invoice, regardless of whether the Customer states something otherwise upon making payment.

6. Delivery

6.1 Forever Spring will deliver the Products ordered to the delivery address stated by the Customer. For every order, the Customer must state whether the delivery address is the same as the billing address; it is possible to specify a different delivery address during the ordering process.

6.2 Deliveries to addresses in the European Union will be made from the United Kingdom and only to full postal addresses, no deliveries will be made to a post office box address. Delivery of the Products ordered will be carried out by a carrier employed for the purpose by Forever Spring.

6.3 Orders will be delivered as quickly as possible after the order has been confirmed and payment received by Forever Spring. In principle Forever Spring aim to have its carrier deliver an ordered Product to the Customer within 10 working days. In general, deliveries will be made on working days between 9:00 a.m. and 5:00 p.m.

6.4 If a Customer orders a Product that is temporarily out of stock, Forever Spring will let the Customer know when that product will become available again.

6.5 If a Customer is not present on the first working day that the ordered Product is delivered, the carrier will deliver the Product again on the next working day. An ordered Product will be delivered to the Customer a total of 3 (three) times. If the Customer is unable to take receipt of the Product, the Customer will receive a card in the letterbox. The card will state a telephone number that the Customer can phone to make a new appointment for delivery.

6.6 The transport and delivery costs that the Customer must pay on ordering a certain Product are stated explicitly on the website.

6.7 Agreed delivery times or dates are approximate only and are never deemed to constitute a deadline. If a Customer has yet to meet an obligation toward Forever Spring on any basis whatsoever, including making advance payment, whether by instalment or otherwise, Forever Spring is entitled to suspend delivery or supply of Products. If a delivery time or date is exceeded because the Customer did not give clear instructions in respect of delivery, supply or other 7. Retention of title

7.1 All Products delivered by Forever Spring will remain the property of Forever Spring until the amount due under the agreement is paid in full, including any interest and costs of collection due.

8. Conformity and warranty

8.1 Forever Spring warrants that the Products comply with the agreement, the specifications stated in the offer, the reasonable requirements of fitness for purpose and the statutory provisions and/or government regulations in existence on the date on which the agreement was concluded.

8.2 An arrangement offered as a guarantee by Forever Spring or Purple Sound does not prejudice the rights and claims the Customer can assert vis-à-vis Forever Spring in respect of a failure by Go10 to perform its obligations under the law and/or the agreement.

8.3 A limited manufacturer’s European Union two (2) year warranty is connected with Purple Sound Products bought from Forever Spring by a Customer who is not acting in the exercise of his profession or business. The Customer will find information about this in the Warranty section of the Website.

8.4 A Customer may only claim a statutory warranty from Forever Spring if the Product is bought through the Website or from an authorised reseller as listed on the Website.

8.5 The statutory period of guarantee commences when the Product is delivered, and the invoice or sales receipt serves as guarantee certificate.

9. Intellectual Property Rights

9.1 All intellectual property rights in relation to the Purple Sound Products sold and supplied by Forever Spring remain the property of Sound Reaver Limited. This includes copyrights, patent rights, trademark rights, design rights, know-how, the right to a trade name, database rights and exclusive licensing rights.

10. Liability

10.1 Information on the Website is purely intended for information purposes and is not meant as advice. If this Website includes links to other websites that may be of interest to Customers, neither Sound Reaver Limited or Forever Spring will be liable for any damage Customers may suffer as a result of visiting such website. Such damage includes but is not limited to that caused by a virus or through inaccuracy or incompleteness of the information posted on that website.

11. Miscellaneous

11.1 If any of the provisions of the Terms and Conditions is invalid or is declared to be void or non-binding, this does not alter the validity of the other provisions. In the event that one or more provisions have been or are declared to be invalid, void or non-binding, Forever Spring and the Customer will agree alternative provisions that are valid and that most closely approximate the content and tenor of the provision(s) that proved to be invalid, void or non- binding.

11.2 Any rights and obligations arising from these Terms and Conditions for the Customer are non-transferable, unless this is stipulated in so many words in these Terms and Conditions or it has been explicitly agreed with Forever Spring in writing.

11.3 Changes or additions to any provision in the Terms and Conditions are only valid if they have been agreed by the parties in writing.

12. Choice of Law

These Terms & Conditions shall be governed by the laws of England & Wales.
